3.         Monthly Recurring Charge Per Circuit  As of December 1, 2003, Starter, Basic and Premium charges are no longer available for new installations.  Monthly recurring rates are based on speed and type of service and are billed monthly in advance.

4.         Equipment and Maintenance Charges: A non-recurring charge and a monthly recurring charge may apply per circuit, based on Customer’s service term commitment.  The non-recurring charge may apply to the provision of a service configuration, one jack, up to 100 feet of cabling from the nearest telephone company closet or cross connect panel serving the Customer, equipment placement, and initial service testing.  The monthly recurring charge may apply to the maintenance of the circuit.  The non-recurring charge will appear on the Customer’s initial invoice.

5.         Other Non-Recurring Charges:

 

5.1       Administrative Non-Recurring Charges

 

5.2       Repair:  Repair services required due to the failure of Company-provided equipment in normal use are covered by the Equipment and Maintenance Charges described above.  The following charges apply for time and material to repair or replace service equipment situated at Customer service locations, if such equipment is lost or damaged as a result of the negligence or willful misconduct of the Customer or its representatives.

5.2.1    A $540 charge applies to replace a modem.

II.         Service Level Agreement:  No service level agreements apply to service.  The Company will repair service, as necessary, within a reasonable time of being notified of a service deficiency.
