DS-3 Local Access

 

I.          RATES AND CHARGES: For new circuits installed on or after March 1, 2010, when the local loop is provisioned entirely on MCI Legacy Company-owned fiber (Type 1 – Lit Building), or on other Company facilities designated as Type 1 on the Guide, Type 1 monthly recurring charges apply.

 

1.         DS-3 Local Access Monthly Recurring Charges:

 

1.1            Verizon Business Services III Monthly Recurring Charges (prior to and after 11/1/216/1/22) these charges apply to all circuits installed prior to and after November 1, 2021June 1, 2022, except that for certain circuits in legacy networks designated by Company, the prior charges will remain in effect as follows, unless that circuit is upgraded or downgraded, or the Customer agreement covering such circuit is replaced by a new, renewed or amended Customer agreement:

 

·        For certain legacy network designated circuits installed from November 1, 2021 through May 31, 2022, Customer will pay Verizon Business Services III Monthly Recurring Charges (11/1/21 through 5/31/22)

·        For certain legacy network designated circuits installed from October 1, 2020 through October 31, 2021, Customer will pay Verizon Business Services III Monthly Recurring Charges (10/1/20 through 10/31/21) 

·        For certain legacy network designated circuits installed from January 1, 2020 through September 30, 2020, Customer will pay Verizon Business Services III Monthly Recurring Charges (1/1/20 through 9/30/20)

 ·        For certain legacy network designated circuits installed from February 1, 2019 through December 31, 2019, Customer will pay Verizon Business Services III Monthly Recurring Charges (2/1/19 through 12/31/19)

·        For certain legacy network designated circuits installed from July 1, 2018 through January 31, 2019, Customer will pay Verizon Business Services III Monthly Recurring Charges (7/1/18 through 1/31/19)

·        For certain legacy network designated circuits installed from April 1, 2018 through June 30, 2018, Customer will pay Verizon Business Services III Monthly Recurring Charges (4/1/18 through 6/30/18)

·        For certain legacy network designated circuits installed from November 1, 2017 through March 31, 2018, Customer will pay Verizon Business Services III Monthly Recurring Charges (11/1/17 through 3/31/18).

·        For certain legacy network designated circuits installed from March 1, 2017 through October 31, 2017, Customer will pay Verizon Business Services III Monthly Recurring Charges (3/1/17 through 10/31/17).

·        For certain legacy network designated circuits installed from June 1, 2016 through February 28, 2017, Customer will pay Verizon Business Services III Monthly Recurring Charges (6/1/16 through 2/28/17).

·        For certain legacy network designated circuits installed from March 1, 2016 through May 31, 2016, Customer will pay Verizon Business Services III Monthly Recurring Charges (3/1/16 through 5/31/16)

·        For certain legacy network designated circuits installed from March 1, 2015 through February 29, 2016, Customer will pay Verizon Business Services III Monthly Recurring Charges (in effect from March 1, 2015 through February 29, 2016);

·        For certain legacy network designated circuits installed from April 1, 2014 through February 28, 2015, Customer will pay Verizon Business Services III Monthly Recurring Charges (in effect from April 1, 2014 through February 28, 2015);

·        For certain legacy network designated circuits installed from May 1, 2013 through March 31, 2014, Customer will pay Verizon Business Services III Monthly Recurring Charges (in effect from April 1, 2013 to March 31, 2014); and

·        For certain legacy network designated circuits installed prior to April 1, 2013, Customer will pay the monthly Verizon Business Service III monthly recurring charges in effect prior to April 1, 2013.

 

1.2            Verizon Business Services II Monthly Recurring Charges these charges apply to all circuits installed prior to and after November 1, 2021June 1, 2022, except that for certain circuits in legacy networks designated by Company, the prior charges will remain in effect as follows, unless such legacy network designated circuit is upgraded or downgraded, or the Customer agreement covering such circuit is replaced by a new, renewed or amended Customer agreement:

 

·        For certain legacy network designated circuits installed from November 1, 2021 through May 31, 2022, Customer will pay Verizon Business Service II Monthly Recurring Charges (11/1/21 through 5/31/22).

·        For certain legacy network designated circuits installed from October 1, 2020 through October 31, 2021, Customer will pay Verizon Business Services II Monthly Recurring Charges (10/1/20 through 10/31/21). 

·        For certain legacy network designated circuits installed from January 1, 2020 through September 30, 2020, Customer will pay Verizon Business Services II Monthly Recurring Charges (1/1/20 through 9/30/20).

 ·        For certain legacy network designated circuits installed from February 1, 2019 through December 31, 2019, Customer will pay Verizon Business Services II Monthly Recurring Charges (2/1/19 through 12/31/19).

·        For certain legacy network designated circuits installed from July 1, 2018 through January 31, 2019, Customer will pay Verizon Business Services II Monthly Recurring Charges (7/1/18 through 1/31/19).

·        For certain legacy network designated circuits installed from April 1, 2018 through June 30, 2018, Customer will pay Verizon Business Services II Monthly Recurring Charges (4/1/18 through 6/30/18).

·        For certain legacy network designated circuits installed from March 1, 2017 through March 31, 2018, Customer will pay Verizon Business Services II Monthly Recurring Charges (3/1/17 through 3/31/18).

·        For certain legacy network designated circuits installed from June 1, 2016 through February 28, 2017, Customer will pay Verizon Business Services II Monthly Recurring Charges (6/1/16 through 2/28/17).

·        For certain legacy network designated circuits installed from March 1, 2016 through May 31, 2016, Customer will pay Verizon Business Services II Monthly Recurring Charges (3/1/16 through 5/31/16)

·        For certain legacy network designated circuits installed from March 1, 2015 through February 29, 2016, Customer will pay Verizon Business Services II Monthly Recurring Charges (in effect from March 1, 2015 through February 29, 2016);

·        For certain legacy network designated circuits installed from April 1, 2014 through February 28, 2015, Customer will pay Verizon Business Services II Monthly Recurring Charges (in effect from April 1, 2014 through February 28, 2015);

·        For certain legacy network designated circuits installed from May 1, 2013 through March 31, 2014, Customer will pay Verizon Business Services II Monthly Recurring Charges (in effect from May 1, 2013 through March 31, 2014);

·        For certain legacy network designated circuits installed from May 1, 2012 through April 30, 2013, Customer will pay Verizon Business Services II Monthly Recurring Charges (in effect from May 1, 2012 through April 30, 2013); and

·        For certain legacy network designated circuits installed prior to May 1, 2012, Customer will pay Verizon Business Service II monthly recurring charges (in effect prior to May 1, 2012).

 

1.3       Verizon Business Services I Monthly Recurring Charges

 

1.3            Pre-Verizon Business Services I Monthly Recurring Charges - these charges apply to all circuits installed prior to and after November 1, 2021June 1, 2022, except that for certain circuits in legacy networks designated by Company, the prior charges will remain in effect as follows, unless that circuit is upgraded or downgraded, or the Customer agreement covering such circuit is replaced by a new, renewed or amended Customer agreement:

 

·        For certain legacy network designated circuits installed from November 1, 2021 through May 31, 2022, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (11/1/2021 through 5/31/2022)

·        For certain legacy network designated circuits installed from October 1, 2020 through October 31, 2021, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (10/1/2020 through 10/31/2021) 

·        For certain legacy network designated circuits installed from January 1, 2020 through September 30, 2020, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (1/1/2020 through 9/30/2020)

·        For certain legacy network designated circuits installed from October 1, 2017 through December 31, 2019, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (10/1/2017 through 12/31/2019)

·        For certain legacy network designated circuits installed from March 1, 2017 through September 30, 2017, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (3/1/2017 through 9/30/2017);

·        For certain legacy network designated circuits installed from June 1, 2016 through February 28, 2017, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (6/1/16 through 2/28/17);

·        For certain legacy network designated circuits installed from March 1, 2016 through May 31, 2016, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (3/1/16 through 5/31/16);

·        For certain legacy network designated circuits installed from March 1, 2015 through February 29, 2016, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (in effect from March 1, 2015 through February 29, 2016);

·        For certain legacy network designated circuits installed from April 1, 2014 through February 28, 2015, Customer will pay Pre-Verizon Business Services I Monthly Recurring Charges (in effect from April 1, 2014 through February 28, 2015)

·        For certain legacy network designated circuits, installed between September 1, 2012 and March 31, 2014, the monthly Pre-Verizon Business Service I monthly recurring charges (in effect between September 1, 2012 and March 31, 2014); 

·        For certain legacy network designated circuits, the monthly Pre-Verizon Business Service I monthly recurring charges (in effect prior to September 1, 2012).

 

2.         DS-3 Local Access Non-Recurring Charges. A non-recurring per-circuit charge of $1000 will apply.

 

3.         Access Coordination. The following charges will apply, per Local Loop, only for circuits installed prior to October 1, 1998 and only if either: (1) the MCI Legacy Company orders the Local Loop; or (2) in the case of Customer-provided access, if the Customer has not provided written notice to the MCI Legacy Company that the Customer accepts responsibility for the design, installation coordination and ongoing coordination of testing and trouble resolution for the Local Loop.

4.         Central Office Connection. The following monthly recurring and non-recurring charges will apply, per connection, only for circuits installed prior to October 1, 1998, whether access is MCI Legacy Company‑provided or Customer‑provided.

5.         M1/3 Multiplex

 

5.1       Verizon Business Services I. A $300 monthly recurring charge applies, per Central Office Connection, to demultiplex/multiplex up to 28 T‑1 (1.544 Mbps) channels from/into a TDS‑45 (44.736 Mbps) digital signal for circuits provided under Verizon Business Services I.

 

5.2       Pre-Verizon Business Services I, Verizon Business Services II and Verizon Business Services III. A $950 monthly recurring charge applies, per Central Office Connection, to demultiplex/multiplex up to 28 T‑1 (1.544 Mbps) channels from/into a TDS‑45 (44.736 Mbps) digital signal.

 

6.         Network Connection Charge

 

6.1.      Verizon Business Services I. A $1,000 monthly recurring charge applies, per connection, for circuits provided under Verizon Business Services I if access is Customer‑provided.

 

 6.2.     Pre-Verizon Business Services I, Verizon Business Services II and Verizon Business Services III. The following monthly recurring and non-recurring charges will apply, per connection, only for circuits installed on or after October 1, 1998, if access is Customer-provided. These charges apply to all circuits with the exception of some circuits installed before March 1, 2013 on certain legacy networks designated by Company. For these designated circuits the Network Connection monthly recurring charges in effect prior to March 1, 2013, the applicable charge below will remain in effect, unless that circuit is upgraded or downgraded, or the Customer agreement covering such circuit is replaced by a new, renewed or amended Customer agreement.

The following monthly recurring and non-recurring charges will apply, per connection, to all circuits installed between March 1, 2013 and February 28, 2015 on certain legacy networks designated by Company. For these designated circuits the Network Connection monthly recurring charges in effect between March 1, 2013 and February 28, 2015, the applicable charge below will remain in effect, unless that circuit is upgraded or downgraded, or the Customer agreement covering such circuit is replaced by a new, renewed or amended Customer agreement.

7.         Cross Connect Charge. A monthly $250 charge will apply, and a non-recurring charge of $500 will apply, per connection, for circuits installed on or after October 1, 1998, for the electrical connection of a MCI Legacy Company affiliate DS-3 Local Access circuit to an interexchange carrier other than the MCI Legacy Company.

 

8.         Charges for special arrangements, including engineering, construction, labor, facility costs and other costs associated with making the interconnection compatible between the Customer's and the MCI Legacy Company’s equipment and/or facilities are additional and at the expense of the Customer and shall be charged on an individual case basis.

 

9.         There will be no allowance for service deferral on the Local Loop. All charges for access begin on the original service request date, or the Telco delivery date, whichever is later.

 

10.       Other Non-Recurring Charges

 

10.1     Customer Support Services charges apply.

 

10.2     Administrative Non-Recurring Charges

 

11.       FUSF and CCRC apply.

 

12.       Paper Invoice Charge applies.

 

13.       Convenience Payment Charge applies.

 

14.       Administrative Expense Fee applies.

 

II.

 

1.         Credit Allowance for Interruption of Local Access Service.

 

2.         Commitment Period. Customer commits to pay the applicable circuit MRC for any Network Services Local Access Service circuit of DS3 or larger for a minimum of 12 months, which Customer must pay even if the circuit is cancelled sooner (unless cancelled by Customer for Cause, as defined in Customer’s service agreement).
