Offer: The following promotional benefits:
a 5 percent discount on monthly recurring charges and excess usage non-recurring charges for Premium Data Center Services Internet Access Service during the term of service for Data Center Services to which the Customer subscribes under this promotion and for which the Customer requests installation on a date following promotion enrollment and prior to April 30, 2004;
waiver of:
installation charges for Data Center Services Internet Access Service, Load Balancing Services and Backup and Restore Services installed following promotional enrollment and prior to April 30, 2004; and,
applicable early termination and underutilization charges under the term of service to which the Customer subscribes under this promotion, if the Company, within the 180-day period following installation of all Premium Data Center Services to which the Customer subscribes under this promotion, receives (i) written notification from the Customer that it wishes to discontinue the plan and (ii) written explanation of the Customers dissatisfaction with the service provided under this promotion;
waiver, during the 90-day period beginning upon Customers initial contact with a Company Premium Data Center Services installation engineer, of:
charges for a Company Migration Project Manager; and,
per-hour On-Site Technical Support/Hands and Eyes Support charges for up to five hours during each monthly period.
Eligibility: To be eligible for this promotion, the Customer must:
enroll between July 1, 2003 and March 31, 2004;
supply to the Company a copy of a recent invoice for colocation service provided by an entity other than the Company;
migrate colocation services from a service provider other than the Company to Premium Data Center Services;
subscribe to Premium Data Center Services under a term of service which equals or exceeds one year; and,
satisfy the minimum volume requirement for the Premium Data Center Services Equipment Space Options to which the Customer subscribes under this promotion.
Other Requirements: The Customer may not receive the benefits of any other promotional offering or discounts on Premium Data Center Services, other than those provided under Special Customer Arrangements (SCA) Guide Types 2 through 9.
