Combination of Promotions

 

Beginning March 18, 2003, this promotion will not be available to new Customers of the promotion.  Customers qualifying for more than one of the promotional discounts specified in Sections V.3. and/or V.4. may obtain a wholly additive application of such discounts up to a maximum of 10%, such that if the applicable discount in the relevant discount schedule for CustomOne is 10%, a 5% discount under Section V.3 plus a 5% discount under Section V.4. (maximum 10% total) plus 10% would equal 20%.

 

Competitive Response Promotion

 

From time to time through March 18, 2003, Company may match specific written offers made by other Interexchange carriers where the customer can demonstrate to Company's satisfaction that it intends to accept such offer as an inducement to subscribe to or remain subscribed to such other Interexchange carrier's services.  This Competitive Response Promotion may be limited to certain dates, times and geographical areas.

 

CustomOne Product Promotion

 

Beginning March 18, 2003, this promotion will not be available to new Customers of the promotion.   Existing Customers with WilPlus II or WilPlus III Service (Existing Service) subject to a Term Service Commitment Period that effect a Service Application for CustomOne Service (New Service) at any time during the Existing Service Commitment Period, shall not be subject to any cancellation charge for the Minimum Monthly Charge relevant to Existing Service, provided the Service Commitment Period of the New Service arrangement is the greater of one year or the remaining term of the Existing Service agreement.  The Requested Service Date for the New Service arrangement shall be as of a date not earlier than thirty (30) days following Customer's submission and Company's acceptance of the relevant Service Application.

 

General Switched Service Promotions

 

From time to time through March 18, 2003, Company will provide one or a combination of the following offerings for Customers who order CustomOne Service subject to a Service Commitment Period of at least one (1) year: (a) credit up to one month's interstate Measured Service charges net of all discounts per year of the Service Commitment Period, which will be applied only to actual interstate Measured Service charges (net of all discounts) for each year of Service Commitment Period; and/or (b) waive Company Installation charges for the Dedicated Access; and/or (c) waive the Installation charges for Local Access Dedicated Access facilities associated with Service; and/or (d) waive certain Ancillary Charges.  This General Switched Service Promotion may be limited to certain dates, times and geographical areas, but the geographical area shall not be less than an entire state.

 

Initial Order Promotion

 

From time to time through March 18, 2003, New CustomOne Customers (i.e., Customers that have not subscribed to a Company Service under this Tariff for a period of at least one year or Customers desiring subscription to CustomOne Service which had not previously been available under this Tariff) that provide  Company with notice of eligibility will obtain a discount of at least 1% and up to 5% with respect to measured usage charges for CustomOne Service then ordered and subject to at least a one (1) year Service Commitment Period in addition to the applicable discount set forth in the discount schedules in Section IV.  The discount shall be evenly proportionate to the aggregate Base Rate charges represented by such order, length of Service Commitment Period, Requested Service Date(s) and number and type of Dedicated Access Channels comprising such order.  The relevant discount shall be wholly additive, such that if the applicable discount in the CustomOne discount schedule is 10%, a 3% discount under this Initial Order Promotion plus 10% would equal 13%.

 

Obsolete Product Promotion

 

Beginning March 18, 2003, this promotion will not be available to new Customers of the promotion.  Customers with an obsolete service as described in Company's F.C.C. No. 7 Tariff subject to a Term Service Commitment Period that effect a Service Application for CustomOne Service at any time during the Service Commitment Period of the obsolete service shall not be subject to any cancellation charge for the Minimum Monthly Charge relevant to their obsolete service.

 

PIC Promotion

 

From time to time through March 18, 2003, Company will offer as an inducement to new and/or existing Customers who subscribe and use new or additional Service in response to media advertising, direct mail materials, Company authorized telemarketing programs and or personal sales presentations, which offer such an inducement one of the following: (a) a credit against Customer's account for Service under this Tariff in an amount equal to the amount charged by the Local Access Provider to switch the new Customer from his previous long distance carrier to Company or (b) a credit against Customer's account for Service under this Tariff in an amount not to exceed $15.00 of the amount charged by the Local Access Provider to switch the new Customer from his previous long distance carrier to Company.  This PIC Promotion is limited to 100 lines from any one location of a customer.  This PIC Promotion may be limited to certain dates, times and geographical areas, but the geographical area shall not be less than an entire state.

 

Service Potentiality Promotion

 

Beginning March 18, 2003, this promotion will not be available to new Customers of the promotion.  Customers obtaining Services from other carriers that provide Company with notice of eligibility will obtain a discount of at least 1% and up to 5% with respect to Measured Service charges for CustomOne Service then ordered and subject to at least a one (1) year Service Commitment Period in addition to the applicable discount set forth in the discount schedules in Section IV.  The discount shall be evenly proportionate to the aggregate Base Rate charges represented by such order, length of Service Commitment Period, Requested Service Date(s), number and type of Dedicated Access Channels comprising such order and volume of similar services then obtained by Customer from other carriers.  The relevant discount shall be wholly additive, such that if the applicable discount in the CustomOne discount schedule is 10%, a 3% discount under this Potentiality Promotion plus 10% would equal 13%.  Customer's eligibility will be conditioned upon a request by Company that Customer timely provide Company satisfactory documentation regarding the level of other domestic usage sensitive services then obtained by Customer from other carriers.

 

Install Fee Waiver

 

Beginning October 1, 1994, and ending December 31, 1994, Company will waive installation Charges for all Enhanced 800 features for new Customers subscribing to CustomOne Enhanced 800 for the first time.  Customers eligible for this promotion are new CustomOne Customers (i.e., Customers that have not subscribed to a Company Service under this Tariff for a period of at least one year or Customers desiring subscription to CustomOne Service which had not previously been available under this Tariff), or CustomOne Customers who have never subscribed to CustomOne Enahanced 800.

 

Payment Arrangements Promotion

 

From time to time the Company may modify its payment arrangements with Customers and extend the date after which a late fee shall apply from thirty (30) days to forty-five (45) days after the Due Date based on other security or payment arrangements acceptable to the Company, including without limitation one or more of the following agreements:  security agreement, guaranty, letter of credit, blocked account agreement, third party lockbox agreement or escrow agreement.

 

Real-Time ANI Delivery Fee Waiver

 

Beginning October 1, 1994, and ending December 31, 1994, Company will waive the $0.01 per ANI Delivery fee for new Customers subscribing to CustomOne Enhanced 800 for the first time.  Customers eligible for this promotion are new CustomOne Customers (i.e., Customers that have not subscribed to a Company Service under this Tariff for a period of at least one year or Customers desiring subscription to CustomOne Service which had not previously been available under this Tariff), or CustomOne Customers who have never subscribed to CustomOne Enhanced 800.           

 

Route Completion

 

Beginning October 1, 1994, and ending December 31, 1994, Company will waive the monthly recurring fee for Route Completion for new Customers subscribing to CustomOne Enhanced 800 for the first time.  Customers eligible for this promotion are new CustomOne Customers (i.e., Customers that have not subscribed to a Company Service under this Tariff for a period of at least one year or Customers desiring subscription to CustomOne Service which had not previously been available under this Tariff), or CustomOne Customers who have never subscribed to CustomOne Enhanced 800.

 

Satisfaction Guarantee

 

New Customers subscribing to a CustomOne Pricing Plan for the first time prior to March 31, 1995 who are not fully satisfied with their Service  may cancel their Pricing Plan within 90 days of the Start of Service Date without liability as set forth in Section IV.11..04.C.i, subject to the terms and conditions set forth in Section II.11.  Customers must provide written notification of cancellation, which must be received by Company, within 90 days of original term commencement.  Within 30 calendar days from receipt of notification, any CustomOne Service remaining with Company will be converted to CustomOne month-to-month rates.

 

T1 For a Buck

 

New Customers subscribing to a CustomOne Pricing Plan for the first time prior to 11/30/94 will receive a T1 local access line for $1 per month  for every $10,000 per month of Annual Commitment measured usage for 1 year provided the Customer commits to a 2 or more year CustomOne Pricing Plan.  There is a maximum monthly cap of $600 per T1 local access line so that the Customer is responsible for payment of any access line cost over $600.  This promotion will be revoked with service cancellation or change in term commitment to less than 2 years.

 

800 Number Promotion

 

New or existing Customers of CustomOne Inbound Service subject to a  Service Commitment period of at least one (1) year who order an 800 number from the Company prior to 11/30/94 shall not be charged the Ancillary Charge of $15.00 per month for the CustomOne 800 Number, up to a maximum of 50 800 numbers, for a period of twelve months from the Start of Service date of the 800 number.
