Section IV.5.5
On-Net Voice Services Term Plan
The following provisions apply to Customers who subscribe to Voice Services under On-Net Voice Services.
The Term Plan is a term plan, in lieu of all other term plans. This plan is not available to Customers subscribing to Feature Options C-1 and C-2. Customers who subscribe to service via the On-Net Voice Services Term Plan are subject to the following conditions:
A. Definition of Terms
Qualifying Volume is the Customers total usage of the following, after the application of promotional and other discounts: domestic and international inbound; outbound; Calling Card (including usage billed to the Customers authorized users under Directed Billing); Toll Free Remote Access usage (including surcharges); and recurring charges for Dedicated Leased Line Service enrolled under the Term Plan; all metered and non-metered rates and charges associated with Option LL service; Feature Option B Customers per-minute usage charges for audioconferencing from networkMCI Conferencing, excluding Data Conferencing; and Tariffed Services for which a tariff is not required and has not been filed. Charges for the following are not included as Qualifying Volume and are not calculated in satisfaction of the Term Plan volume commitment: Directory Assistance usage and surcharges: Optional Features; recurring and non-recurring charges; Operator Assisted usage and surcharges; monthly recurring and non‑recurring charges; and taxes.
Eligible Volume is the Customers total usage of the following, after the application of promotional and other discounts: domestic and international inbound and outbound, Calling Card (including usage billed to the Customers authorized users under Directed Billing), Remote Access (including surcharges), Option LL service usage, per-minute usage charges for audioconferencing from networkMCI Conferencing, excluding Data Conferencing, Inter‑Office Channel. Charges for the following are not included as Eligible Volume and will not receive Term Plan volume discounts: Network Connection Charges; Directory Assistance usage and surcharges; Optional Feature recurring and non-recurring charges; Operator Assisted usage and surcharges; monthly recurring and non‑recurring charges; Local Channel Access, Access Coordination, Central Office Connection, and Access Service Request charges for Terrestrial Digital Service - 45; and taxes.
B. Term Commitment and Renewal Options: A Customer must commit to service for a term of either one, two, three, four, or five years. The term of service will commence no earlier than the fifteenth day of the billing month in which the Customer subscribes to the plan. A plan will automatically renew for an equivalent term and volume commitment upon expiration of its term, unless the Customer provides written notification to cancel the Term Plan, which must be received by the Company no more than 30 days after expiration of the existing term. If the Customer cancels the existing term plan within 30 days after expiration of the existing term, the Customer will receive the discounts for which the Customer qualifies during the 30-day period following the expiration of the existing term of service.
C. Volume Commitment: A Customer must elect an Term Plan annual volume commitment of $1,200, $3,000, $6,000, $12,000, $24,000, $36,000, $48,000, $60,000, $84,000, $120,000, $180,000, $300,000 or $600,000, calculated after the application of promotional and other discounts, except Customers who subscribe to service under an Term Plan prior to October 1, 2000, may elect an Term Plan monthly volume commitment of one of the following amounts, calculated after the application of promotional and other discounts: $100; $250; $500; $1,000; $2,000; $3,000; $4,000; $5,000; or $7,000. Satisfaction of the Customers volume commitment will be based upon the Customers Qualifying Volume. At any time during the term of service, a Customer may elect a higher equivalent annualized volume commitment. If a Customer so elects, the term of service expiration date will not change. The new volume commitment will apply as of the beginning of the commitment year in which the new volume commitment is elected and the Customer must satisfy the new volume commitment in that commitment year; however, the discounts associated with the new commitment volume level apply to usage only from the new election date forward.
D. Underutilization Charges: The following charges will apply.
1. Beginning in the fourth month following a Customers subscription under a monthly volume commitment, if at the end of any monthly period of the term of service, a Customer fails to satisfy its monthly volume commitment, the Customer must pay the difference between the Customers actual Qualifying Volume usage in that monthly period and the Customers monthly volume commitment.
2. For Customers subscribing under an annual volume commitment, if at the end of any annual period of the term of service, a Customer fails to satisfy its annual volume commitment, the Customer must pay the difference between the Customers actual Qualifying Volume usage in that annual period and the Customers annual volume commitment.
1. Cancellation or Discontinuance Without Liability: If: (i) the Customers use of service under a Term Plan equals or exceeds the Customers equivalent annualized minimum volume commitment and (ii) at the time of termination the Customer is enrolled in a new Term Plan with a volume commitment which equals or exceeds the Customers existing volume commitment, the Customer may terminate service under the Term Plan without liability as follows: (i) the Customer may terminate service at any time during the last three months of the term of service if the Customers new Term Plan's term commitment is one year; or (ii) the Customer may terminate service at any time during the last six months of the term of service if the Customers new Term Plan's term commitment is equal to or greater than two years.
2. Cancellation or Discontinuance With Liability: Discontinuance of all services furnished under the Term Plan prior to the expiration of the committed term of service constitutes discontinuance of the plan and the Customer will be billed and required to pay an early termination charge as follows:
2.1 Customers subscribing under a monthly volume commitment will be required to pay a charge in an amount equal to (i) the Underutilization Charge for the monthly period of termination, (ii) the Customers monthly volume commitment for each month remaining in the annual period of termination, and (iii) 50 percent of the Customers monthly volume commitment for each monthly period remaining in the unfulfilled term of service.
2.2 Customers subscribing under an annual volume commitment will be required to pay a charge in an amount equal to (i) the Underutilization Charge for the annual period of termination and (ii) 50 percent of the annual volume commitment for each annual period remaining in the unfulfilled term of service.
F. Discounts: Customers will receive the following discounts applied to Eligible Volume usage:

2. The following discounts apply to monthly recurring Inter-Office Channel charges for Voice Grade Private Line and Digital Private Line Service (excluding Fractional T-1 - Digital Private Line Service at speeds between 112 kbps and 1,472 kbps):
