IMPORTANT NOTICE RELATING TO THIS GUIDE AND FORMER TARIFFS

 

Prior to August 1, 2001, service was furnished under MCI Telecommunications, Inc.{“MCIT”), Tariff FCC No. 7 filed with the Federal Communications Commission and now canceled.  Beginning August 1, 2001, service is being furnished pursuant to this Guide and any underlying written contract between the Company and the Customer.

 

Please not the following regarding this important change.

 

·                  MCIT Tariff FCC No. 7 was amended on June 23, 2001 to incorporate new or revised General Definitions and new or revised General Terms and Conditions of Service contained in WorldCom Tariff FCC No. 1.  Like the service in former MCIT Tariff FCC No. 7, these General Definitions and General Terms and Conditions are now part of this Guide and, therefore, are part of customer service contracts.  Some of the definitions and terms and conditions contained in former MCIT Tariff FCC No. 7are reflected in the General Definitions and General Terms and Conditions of Service and, accordingly, were removed from the former tariff at the time of detariffing on July 31, 2001. This explains why there may be omissions or “gaps” in the service information previously found in MCIT Tariff FCC. No. 7 and currently contained in this Guide.

 

·                  Except as noted in the preceding paragraph, the text of this Guide replicates the information contained in former MCIT Tariff FCC No. 7 on July 31, 2001.

 

·                  If there is an inconsistency between a General Definition or a General Term and Condition, a service-specific definition or term and condition, or a definition and term and condition contained in a written contract between the Company and the Customer, the relationship with the Customer will consist of the following, in order of precedence from (1) through (3): (1) the definition or term and condition in the written contract; (2) the service-specific definition or term and condition; and (3) the General Definition or Term and Condition.  An “inconsistency” will be deemed to include any instance in which a service-specific definition or a service-specific term and condition has no counterpart in the General Definitions or the General Terms and Conditions of Service.

 

·                  The Company may change the Guide from time to time and any change made will be binding on customers after fulfillment of the notice period set forth in Section 7.B of the General Terms and Conditions.

 

Any reference to “tariff” within the text of the Guide shall mean “Guide.”


DEFINITION OF TERMS

 

Effective June 23, 2001, all Definitions of Terms are superseded by the General Definitions contained in WORLDCOM Tariff F.C.C No. 1, except as otherwise provided for in Section 1.C.01 thereof.

 

            800 Subscriber

 

            An 800 Subscriber is the agency, department, instrumentality, or other entity of the United States Government or such an agency, department, instrumentality, or other entity which is providing service to the United States Government that, in accordance with SMS/800 procedures, controls an 800 number and has the right to designate its Resp Org.

 

            Access Coordination

 

            Provides for the design, ordering, installation coordination, pre-service testing, service turn-up and maintenance of a Company- or customer-provided local access channel.

 

            Access Line

 

            A dedicated arrangement which connects a customer location to a Company terminal location or a Company switching center.

 

            Administrative Change

 

            The modification of an existing circuit, dedicated access line or port, at the request of the customer, that involves changes to authorization codes, speed numbers, route guide, consolidation of billing within Dedicated Access Line Service, verification of testing performed by parties other than Company, or any other administrative change not covered by a Billing Record Change.

 

            Attempted Delivery

 

            Denoted a procedure whereby Company will attempt to connect an authorized facsimile terminal designated by a subscriber to the facsimile service system in order to enable the transmission of facsimile data to the designated compatible authorized facsimile terminal.  Availability of the designated authorized facsimile terminal is not the responsibility of Company.

 

            Attenuation Distortion

 

            The difference between the amount of power lost at certain frequencies compared to the power lost at frequency of 1004 Hz.  Used in connection with C-type conditioning.

 

            Authorization Code

 

            One or more codes (consisting of 5 or more digits) made available to customer to identify themselves as users authorized access to, and use of, Company Government Telecommunications Services.

 

 

 

 

 

 

 

 

            B8ZS (Bipolar 8 Zero Substitution)

 

            A DS1 line coding technique that enables digitized voice and data transmission at the rate of 1.536 Mbps independent of the number of consecutive zeros and pulse density requirements that are normally imposed on the T1 transmission line.

 

 

 

 

 

 

 

 

            Cancellation of Order

 

            A customer-initiated request to discontinue processing a service order, either in part or in its entirety, prior to the commencement of an ordered service.   Company will assess charges against the customer for each circuit-end or dedicated access line so canceled if (1) the local exchange carrier has confirmed in writing that the circuit-end or dedicated access line will be installed; or (2) Company has already submitted facilities orders to an interconnecting carrier.  (This differs from a disconnection.)

 

            Central Office Connection (COC)

 

            Connects the Company Inter-Office Channel of a dedicated transmission circuit or connects the access port of a switched channel to a Local Access Channel.

 

 

 

 

 

 

 

 

            Clear Channel Capability

 

            The capability to permit the unrestricted use of a digital communications channel independent of the number of consecutive zeros and pulse density requirements (i.e., 64 kbps usable bandwidth for a DSO channel and 1.536 Mbps usable bandwidth for a DS1 channel).

           

Company Terminal

 

Any Company location where Company provides services as described herein.

 

Customer

 

            A customer is anyone providing service under a direct contractual arrangement to a department, agency or instrumentality of the United States Government under this tariff.  A customer may also be any department, agency or instrumentality of the United States Government.  For purposes of SMS Resp Org Changes, the customer is the agency, department, instrumentality, or other entity of the United States Government or such agency, department, instrumentality, or other entity providing service to the United States Government that submits the change request.

 

            Customer Premises

 

            A location, free of any interfering easements, designated by the customer for the origination and termination of Government Telecommunications Services to the customer or its authorized user(s).

 


DSU (Data Service Unit)

 

            A device that connects a customer's premises or serving central office and the Company terminal for origination or termination of calls.

 

 

 

 

 

            Direct Termination Overflow

An option which allows a Gnt or Gnt 800 customer to direct that calls to a specific Dedicated Termination line group shall be routed over Company’s shared network if all Dedicated Termination lines in the group are busy.

 

            Disconnection

 

            The physical disconnection of a circuit, dedicated access line or port connection being used for existing service.

 

            Emergency Service

 

            Company provides its customers, through Company operators, telephone access to public safety answering points in the localities.  When Company routes a call to a public safety answering point or a municipal emergency service provider, this service shall be known as emergency service.

 

            Envelope Delay Distortion

 

            A measure of linearity of the phase versus frequency of a channel.  The maximum variation over a band of frequencies of the envelope delay, a derivative of the phase with respect to frequency.  Used in connection with C-type conditioning.

 

 

 

 

 

 

            Expedite

 

            A customer-initiated service order, plus the accompanying installation or the charge to related circuits, that is processed in a time period shorter than Company’s standard service interval.

 

            Facilities

 

            Any item of communications plant or equipment other than Customer-Provided Terminal Equipment used to provide or to connect to Company service.

 

            Fiber-Only Routing

 

            A channel that is provisioned exclusively on fiber optic transmission facilities.

 

            Installation

 

            The connection of a circuit, dedicated access channel or port for new or additional service.

 

            Institutional Phones

 

            Telephones, other than payphones, located in public institutions such as universities, prisons, or public offices, or in hotels or motels, or in other premises where the subscriber to Company

service may not be able to control access to the phones.

 

            Intermodulation Distortion

 

            A measure of the non-linearity of a channel used in connection with D-type conditioning.

 

            Inter-Office Channel

 

            The long-haul portion of a dedicated circuit that connects two or more points of presence in distant cities.

 

            Inter-Office Conditioning

 

            Special adjustments made to the long-haul portion of a dedicated circuit (required for data circuits only) to assure specific performance levels required for high-speed data transmission.

 

            Inter-Office Signalling

 

            Signaling (as defined herein) which applies to dedicated circuits carrying voice traffic only.

 

            Invoice

 

            The term "Invoice" as used in connection the Metered Use Service Option B (MCI Gnt 800) denotes all service groups (locations) and MCI Gnt 800 numbers associated with a single Corporate ID.

 

            Joint User

 

            A person, firm or corporation designated by the customer as a user of communication facilities furnished to the customer by Company, and to whom a portion of the charges for such facilities are billed under a joint user arrangement.

 

 

 

 

 

 

            Local Access Channel Data Conditioning

 

            Special conditioning of the local access channel of a dedicated circuit in order to meet performance specifications required for processing data over the circuit.  The customer is responsible for requesting the specific type of conditioning required.

                        In the multipoint application, all transmission is from a master Customer's premises to each of 2 or 3 remote Customer's premises.  Transmission is not possible between the remote Customer's premises.

 

                        C-5 Conditioning - C-5 conditioning is available for two-point channels where both Customer's premises are located in the Mainland.  The attenuation distortion and envelope delay distortion parameters for C-5 conditioning are:

            Multiline Terminating Device

 

            Denotes switching equipment, key telephone type systems or other similar customer premise terminating equipment which, is capable of terminating more than one access line.

 

            Multipoint Arrangement

 

            An arrangement whereby an Inter-Office Channel connects customer locations served by more than two Company Points of Presence and/or where an Inter-Office Channel connecting two or more Company POPs connects two or more customer locations.

 

            National Security Emergency Preparedness (NSEP)

 

            Government requirement for maintenance of a state of readiness for, response to, management of, an event or crisis, which causes or threatens injury or harm to the population, damage to or loss of property, or otherwise would degrade or jeopardize the National Security Emergency Preparedness of the United States Government.

 

            Network Channel Terminating Equipment (NCTE)

 

            A device that connects a customer's data terminal equipment to the Local Access Channel of Terrestrial Digital Service (including T-1 Digital Access).

 

            Off-net

 

            A location which does not subscribe to MCI Gnt service.

 

            On-net

 

            A location which subscribes to Gnt service.

 

            One-Way Transmission

            The capability of transmission in only one direction.

 

 

 

 

 

 

 

 

            Premises

            The space designated by a customer at its place or places of business for termination of Company service, for its own communications needs.

 

            Rate Center

            A specified geographical location used for determining mileage measurements.

 

            Redundancy

            The provision of alternate Government Telecommunications Services using one or more different routings, circuits, and/or additional equipment.

 

            Resp Org

            A Resp Org is the entity responsible for managing and administering an 800 subscriber's records in the 800 Service Management System (SMS/800).  The SMS/800 recognizes one

            Route Diversity

            Two channels which are furnished partially or entirely over two physically separate routes.

 

            Service Group

            The term "Service Group" as used in connection with Metered Use Service Option B (Gnt 800)

 denotes a group of access lines represented by a lead ANI, a switch/trunk identifying number, or a single telephone number.

            Shared Termination

            Utilization of the local exchange network facilities for termination of Gnt service calls.

 

            Shared Transport

 

            Utilization of Company’s switched network for the long-haul transmission portion of Gnt service calls.

 

            Signal to Noise Ratio

 

            The ratio in dB of a tone signal to the corresponding noise.

 

            Signaling

 

            Line status communications between Company terminals and/or local exchange carrier central offices, required for voice grade dedicated circuits only.

 

            Special Access Surcharge

 

            A charge imposed by the local exchange company in accordance with Section 69.115 of the FCC Rules and Regulations.

 

            Terminal Equipment

 

            Devices, apparatus and their associated wiring, including but not limited to private branch exchanges, channel banks, multiplexors, teleprinters, telephone handsets and data sets.

            Transmission Speed

 

            Analog or digital transmission speed or rate, in bits per seconds (bps).

 

            Twelve O'Clock

 

            In designating time period 12:00 am refers to 12:00 midnight and 12:00 pm refers to 12:00 noon.

 

            Two-Way Transmission

 

            The capability of transmission in either direction or in both directions at once.

 

            U.S. Mainland

 

            The District of Columbia and the 48 coterminous states.


 

Effective June 23, 2001, all Rules and Regulations are superseded by the General Terms and Conditions contained in WORLDCOM Tariff F.C.C No. 1, except as otherwise provided for in Section 1.C.01 thereof.

 

1.         DESCRIPTION OF SERVICE

 

            .01       Government Telecommunications Services are common user telecommunication services furnished by Company between specified locations for Government communications requirements under the terms of this tariff.

 

            .02       Government Telecommunications Services consist of furnishing for the use of customers, or their authorized users, channels for the direct transmission and reception of communications between Company POPs, and all service offerings contained herein which anticipate the provision of such channels as part of the offering.  Such services have the capability of being extended beyond Company POPs.

 

            .03       Acting at the Customer's request and as its authorized agent, Company will make reasonable efforts to arrange for additional service requirements which may include terminal equipment and circuit conditioning.

       .02     Company reserves the right to discontinue furnishing service, upon written notice, when necessitated by conditions beyond its control or when the customer is using the service in violation of the provisions of this tariff, or in violation of the law.

       .06     To the extent applicable, Company services will be subject to the conditions set forth in the Truth in Lending Act, Reg. Z, 12 C.F.R. 226 (1991).

 

3.    TERMS AND CONDITIONS

 

       .01     A customer must place a written service order in a form acceptable to Company to initiate new Government Telecommunications Services or to expand existing services provided by Company.  If an entity that is not a department, agency or other instrumentality of the United States Government places an order for Government Telecommunications Service, the service order must specify the contractual arrangement under which the customer will provide the Government Telecommunications Service to a department(s), agency(ies) or other instrumentality(ies) of the United States Government. Company reserves the right to request to obtain a copy of the contractual arrangement.

 

       .02     Except as otherwise provided in Section C of this tariff, Company provides and bills for service based on minimum period of one (1) month, beginning on the date the billing, under this tariff, becomes effective.  Company will continue to provide such service until the customer cancels such service in writing on not less than thirty (30) days notice from the date of the postmark on the letter giving notice of cancellation.

 

       .03     The customer agrees to operate Company facilities in accordance with instructions of Company or Company’s agents.  Failure to do so will void Company liability for interruption of service and may make customer responsible for damage to equipment pursuant to Section B-3.04 below.

 

       .04     Customer agrees to return to Company all Company-provided equipment and facilities delivered to customer and used to provide service within five (5) days of termination of the service in connection with which the equipment or facilities were used.  Said facilities shall be in the same condition as when delivered to customer, normal wear and tear only excepted.  Customer shall reimburse Company, upon demand, for any costs incurred by Company due to customer's failure to comply with this provision.

 

       .05     Government Telecommunications Service will be provided twenty-four (24) hours per day, seven (7) days per week, either on a monthly or a metered use basis.

 

       .06     The customer is responsible for taking all necessary legal steps for interconnecting its customer-provided terminal equipment or communications systems with Company facilities.  The customer shall secure all licenses, permits, rights-of-way, and other arrangements that may be necessary for such interconnection.

 

       .07     The customer shall ensure that its equipment is properly interfaced with Company facilities, that the signals emitted into Company’s network are of the proper mode, bandwidth, power, data speed, and signal level for the intended use of the customer and in compliance with the criteria set forth in Section B-12 below, and that the signals do not damage Company facilities, injure personnel or degrade service to other customers.  If the Federal Communications Commission or some other appropriate certifying body certifies terminal equipment as being technically acceptable for direct electrical connection with interstate communications service, Company will permit such equipment to be connected with its channels without the use of protective interface devices.  If the customer fails to maintain and operate its equipment properly, with resulting imminent harm to Company facilities, personnel, or the quality of service to other customer, Company may, upon written notice, require the use of protective equipment at the customer's expense.  If this fails to produce satisfactory quality and safety, Company may, upon written notice, terminate the customer's service.

 

       .08     For the purpose of computing charges in this tariff, a month is considered to have thirty (30) days.

 

       .09     Pricing for specially customized service(s) may vary from pricing set forth under the specific service options contained in this Tariff based on volume, term, utilization, and other commitments made by the customer.  However, such pricing shall not exceed any prices established under those specific service options.

 

4.    LIABILITY

 

       .01     Company’s liability for willful misconduct, if established as a result of judicial or administrative proceedings, is not limited by this tariff.  Company’s liability, if any, with regard to the delayed installation of Company facilities or commencement of service, shall not exceed $1,000.  With respect to any other claim or suit, by a customer or any other person, for damages associated with the ordering, installation (including delays thereof), provision, termination, maintenance, repair, interruption, or restoration of any service or facilities offered under this tariff, and subject to the limitations in Section B-4.02 through 4.07 following.  Company’s liability, if any, shall be limited as follows:

 

                        .011      With respect to any Dedicated leased Line Service offered by Company in Section C-2 herein, Company’s liability shall not exceed an amount equivalent to the credit for interruption of service provided for in the relevant subsections of Section C-2.02 of this tariff (principally Section C-2.02116).  With respect to other services offered by Company which have the characteristics of a private line service, Company’s liability shall not exceed an amount equal to the proportionate monthly recurring charge or charges for the service for the period during which the service was affected.

 

       .012      With respect to any service provided by Company which involves dedicated access, shared interexchange transmission, and shared termination, Company’s liability shall not exceed an amount equal to the proportionate monthly recurring charges -- including any service charges, minimum monthly charges, basic feature package charges, monthly charges for optional features, charges for dedicated access facilities and any other monthly charges -- for the period during which the service was affected, or, if only a transmission using the shared interexchange facilities is interrupted, an amount equal to the charge applicable to a one minute call to the called station at the time the affected call was made.

 

.013      With respect to any inbound service provided by Company which involves shared access and shared interexchange transmission and/or shared termination.  Company’s liability shall not exceed an amount equal to the proportionate monthly recurring charges -- including any monthly fee for any option associated with the service, charges for dedicated termination facilities, and any other monthly charges -- for the period during which the service was affected, or, if only a transmission using the shared interexchange facilities is interrupted, an amount equal to the charge applicable to a one minute call to the customer's station at the time, and over the range, of the affected call, taking account of the form of service and type of termination the customer had selected. Where any claim arises out of Company’s acting as a Resp Org or performing SMS Resp Org Changes, or where MCI Gnt 800 service is not made available on the date committed to the customer, or cannot otherwise be made available after Company’s acceptance of the customer's order, or is provided with a number or numbers other than the one(s) committed by Company to the customer, or the number or numbers are not included in 800 Service Directory Assistance or are included in an incorrect form, and any such failure or failures is due solely to the negligence of MCI, in such case Company’s liability, if any, will be limited to the lesser of (a) the actual monetary damages incurred and proved by the customer as the direct result of such failure or failures, or (b) the sum of $1,000.00.  Company shall not be liable at all for the use, misuse, or abuse of a customer's 800 Service by third parties, including, without limitation, the customer's employees or members of the public who dial the customer's 800 number by mistake.  Compensation for any injury the customer may suffer due to the fault of others than Company must be sought from such other parties.  With respect to Resp Org Service and SMS Resp Org Changes, the customer or others authorized to use the service will indemnify and hold Company harmless against any third party claims arising out of the execution of changes requested by the customer, including those changes made by an 800 Subscriber.  Where the Resp Org Service customer is a customer acting on behalf of an 800 Subscriber, the customer represents that it has the authority to act on the 800 Subscriber's behalf in choosing a Resp Org and otherwise utilizing Company’s Resp Org Service.

 

.014      With respect to International Switched Voice Service provided by Company which involves shared access, shared interexchange transmission, and shared termination, Company’s liability shall not exceed an amount equal to the minimum charge applicable to the called station at the time the affected call was made.  If there is a higher initial rate for the service that higher rate shall apply.  This limitation applies to all calls to international points regardless of the Company service to which the customer subscribes.

 

.015      With respect to the routing of calls by Company to public safety answering points or municipal emergency service providers, Company’s liability, if any, will be limited to the lesser of: (a) the actual monetary damages incurred and proved by the customer as the direct result of Company’s action, or failure to act, in routing the call, or (b) the sum of $1,000.00.

 

.016      The liability provided for above, shall, in each case, be in addition to any amounts that may otherwise be due the customer under this tariff as a credit allowance for the interruption of service.  In no event shall Company be liable to customer for any indirect, special, incidental, consequential, exemplary or punitive loss or damage of any kind, including lost profits (whether or not Company has been advised of the possibility of such loss or damages) by reason of any act or omission in its performance under this tariff.

 

       .02     Company shall be indemnified defended, and held harmless by the customer or by others authorized to use the service against all claims of loss or damage arising from the use of service furnished under this tariff including:

 

                        .021      claims for libel, slander, invasion of privacy, or infringement of copyright arising out of the material, data, information, or other content transmitted over Company’s channels transmitted via Company service; and

 

                        .022      patent infringement claims arising from combining or connecting MCI-furnished Government Communications Network Services with apparatus and systems furnished by the customer or others; and

 

                        .023      all other claims arising directly out of acts or omissions of the customer, an authorized user, or others, including those relating to Section B-4.07 following, in connection with any service provided by MCI.

 

       .03     Company is not liable for any act or omission of any other company or companies furnishing a portion of the service, or for damages associated with service, channels, or equipment which it does not furnish, or for damages which result from the operation of customer-provided systems, equipment, facilities or services which are interconnected with Company services.

 

       .04     Company does not guarantee or make any warranty with respect to any service installations at locations containing an atmosphere which is explosive, prone to fire, dangerous or otherwise unsuitable for such installations.  The customer and the user indemnify and hold Company harmless from any and all loss, claims, demands, suits or other action, or any liability whensoever, whether suffered, made, instituted or asserted by the customer or by any other party or persons, for any personal injury to, or death of, any person or persons, and for any loss, damage, or destruction of any property, whether owned by the customer or others, caused or claimed to have been caused directly of indirectly by the installation, operation, failure to operate, maintenance, removal, presence, condition, location or use of service furnished by Company at such locations.

 

       .05     Company is not liable for any defacement of, or damage to, the premises of a customer resulting from the furnishing of channel facilities or the attachment or instruments, apparatus and associated wiring furnished by Company on such customer's premises or by the installation or removal thereof, when such defacement or damage is not the result of Company negligence.  No agents or employees of other participating carriers shall be deemed to be agents or employees of MCI.

 

.06   Except for granting credit allowance for interruptions of service as provided for in Section B-13 and other sections of this tariff, Company shall not be liable for any failure of performance due to causes beyond its control, including but not limited to, acts of God, fires, floods or other catastrophes; national emergencies, insurrections, riots or wars; strikes, lockouts, work stoppages or other labor difficulties; preemption of existing services to restore service in compliance with Part 64, Subpart D, Appendix A of the FCC's Rules and Regulations; and any law, order, regulation or other action of any governing authority or agency thereof.

 

       .07     Company shall not be liable for the customer's failure to fulfill its obligation to take all necessary steps including, without limitation, obtaining, installing and maintaining all necessary equipment, materials and supplies, for interconnecting the terminal equipment or communications system of the customer, or any third party acting as its agent, to the Company network.  The customer shall secure all licenses, permits, rights‑of‑way, and other arrangements necessary for such interconnection.  In addition, the customer shall ensure that its equipment and/or system or that of its agent is properly interfaced with Company service, that the signals emitted into Company’s network are of the proper mode, band‑width, power, data speed, and signal level for the intended use of the customer and in compliance with the criteria set forth in Section B‑12 following, and that the signals do not damage Company equipment, injure its personnel or degrade service to other customers.  If the Federal Communications Commission or some other appropriate certifying body certifies terminal equipment as being technically acceptable for direct electrical connection with interstate communications service, Company will permit such equipment to be connected with its channels without the use of protective interface devices.  If the customer or its agent fails to maintain and operate its equipment and/or system or that of its agent properly, with resulting imminent harm to Company equipment, personnel, or the quality of service to other customers, Company may, upon written notice, require the use of protective equipment at the customer's expense.  If this fails to produce satisfactory quality and safety, Company may, upon written notice, terminate the customer's service without liability.

 

5.    CANCELLATION OF SERVICES BY A CUSTOMER (See Section B-10 for termination by Company)

 

       .01     If a customer cancels service before the commencement of service, or before completion of some other period mutually agreed upon by the customer and Company, the customer shall pay a charge for the nonrecoverable portions of expenditures or liabilities incurred expressly on behalf of the customer by Company and not fully reimbursed by installation and monthly charges not previously paid.  If, prior to the commencement of service, Company or another entity acting at the direction of Company, either has begun or completed construction based on a customer order, the customer shall bear the nonrecoverable cost of such construction.

 

       .02     If Company receives a request for service discontinuance from a foreign carrier furnishing interconnected service to a Customer, but has not yet been notified of such discontinuance by the Customer, Company will contact the Customer and request a written confirmation of the intended discontinuance.  If the Customer does not furnish such written confirmation to Company within five business days, Company will discontinue service as requested by the foreign carrier.  If the Customer elects not to have the service discontinued, it must so indicate in writing within the specified five‑business‑days deadline and provide to Company the lease number assigned to each circuit associated with service.


 

6.    USE OF SERVICES

 

       .01     Service furnished by Company may be used for one or more of the following:

 

                        .011      for the transmission of communications by the customer.

 

                        .012      for the transmission of communications to or from an authorized user or joint user.

 

                        .013      Service furnished by Company may be arranged for resale subject to the following:  The customer will be responsible for all interaction and interface with its own subscribers or customers.

 

 

       .02     Service furnished by Company shall not be used:

 

                        .021      for any unlawful purpose.

 

.022      for any purpose for which any payment or other compensation is received by the customer, except when the customer is an entity which resells Company service exclusively to a department, agency or other instrumentality of the United States Government as part of an enhanced communications service, or other integrated system requirement under a direct contractual arrangement.

 

       .03     Directory Assistance is available to customers of Company’s Gnt services.  An undiscounted charge will be applied to each call for information as to any telephone number in the United States and in Puerto Rico, the U.S. Virgin Islands, Guam, CNMI, and Canada.  The Directory Assistance charge applies to each call regardless of whether the Directory Assistance Bureau is able to furnish the requested telephone number.  The surcharge on credit card calls will not be applied to Directory Assistance calls.  In addition, Directory Assistance calls will not count toward, nor be calculated as part of the Volume Discounts offered under the Metered Use Service Options referenced below.  For International Switched Voice Service, an undiscountable charge will be applied to each call for Directory Assistance in the international locations listed in Section E-2.02.

 

       Directory Assistance charges will be waived if: (1) the customer experiences poor transmission or is disconnected during the call to Directory Assistance; (2) the customer is given an incorrect telephone number by the Directory Assistance operator; or (3) the customer has inadvertently misdialed and reached Directory Assistance for a country not intended.  The customer must notify an Company Customer Service Representative to receive have the charges waived.

 

       .04     Service furnished by Company may be arranged for joint use or authorized use.  The joint user or authorized user shall be permitted to use such service in the same manner as the customer, but subject to the following:

 

.041      One joint user or authorized user must be designated as the customer.  The designated customer does not necessarily have to have communications requirements of his own.  The customer must specifically name all joint users or authorized users in the Application for Service.  Orders which involve the start, rearrangement or discontinuance of joint use or authorized use service will be accepted by Company only from that customer and will be subject to all regulations of this tariff.

 

.042      All charges for the service will be computed as if the service were to be billed to one customer.  The joint user or authorized user which has been designated as the customer will be billed for all components of the service and will be responsible for all payments to the company.  In the event that the designated customer fails to pay the company each joint user or authorized user shall be liable to the company for all charges incurred as a result of its use of Company’s Service.  Each joint or authorized user must submit to the designated customer a letter accepting contingent liability for its portion of all charges billed by the company to the designated customer.  This letter must also specify that the joint or authorized user understands that the company will receive a copy of the guaranty from the designated customer.  The customer shall be responsible for allocating charges to each joint user or authorized user.

       .07     At the request of the domestic customer or with his or her concurrence, or at the request of his or her foreign correspondent, Company may arrange for the provisioning of the international Private Line abroad to interconnect with the domestic circuit.  The customer's order placed with either Company or a foreign carrier may be end-to-end circuit provisioning, single-end billing of the foreign carrier charges, and/or the domestic end charges.  The terms and conditions of service of the respective carriers will apply for each segment of the circuit.

 

7.    PAYMENT ARRANGEMENTS

 

       .01     Accrual charges for Government Telecommunications Service will commence the day following availability to a customer.

 

       .02     The customer is responsible for payment of all charges for services furnished to the customer or its joint or authorized users. This responsibility is not changed by virtue of any use, misuse, or abuse of the customer's service or customer-provided systems, equipment, facilities, or services interconnected to the customer's service, which use, misuse, or abuse may be occasioned by third parties, including without limitation, the customer's employees or other members of the public.  Non-recurring charges are payable when the services for which they are specified have been performed.  If an entity other than Company (e.g., another carrier or a supplier) imposes charges on Company, in addition to its own internal costs, in connection with a service for which a Company non-recurring charge is specified, those charges will be passed on to the customer.  Recurring charges which are fixed in amount and not dependent on usage are billed in advance.  Usage charges are billed after each usage cycle.  For customers, the rate or volume discount level applicable to a customer for a particular service or services shall be the rate or volume discount level in effect at the end of the monthly billing period applicable to the customer for the particular service or services.  For the purpose of computing charges in this tariff, a month is considered to have thirty (30) days.

 

 

 

 

 

 

 

 

       .03     Invoices will be due and payable upon receipt.  Amounts not paid within thirty (30) days after the date of the invoice will be considered past due.  Interest at the applicable rate prescribed in the Prompt Payment Act or other applicable federal law will accrue upon any unpaid amount commencing thirty (30) days after receipt of a proper invoice.

9.    INSPECTION

 

       Company may, upon reasonable notice, make such tests and inspections as may be necessary to determine that the requirements of this tariff are being complied with in the installation, operation or maintenance of customer or Company equipment.  Company may interrupt the service at any time, without penalty to Company, because of departure from any of these requirements.

 

10.   TERMINATION FOR CAUSE BY Company (See Section B-5 for Cancellation by Customer)

 

       Upon nonpayment of any sum past due and owing to Company, or upon a violation of any of the provisions governing the furnishing of service under this tariff, Company may, upon thirty (30) working days written notification to the customer, without incurring any liability, discontinue furnishing such service.

 

 

 

 

11.   TESTS AND ADJUSTMENTS

 

       The customer shall make Company-provided service available to Company for such tests and adjustments as may be necessary to maintain them in satisfactory condition; no interruption allowance will be granted for the time during which such tests and adjustments are made.

13.   ALLOWANCE FOR INTERRUPTIONS

 

       Except as otherwise provided in Section C of this tariff, or Section B-13.024 below, the following credit allowance for interruptions of Company services will be made:

 

       .01     For all Company’s services for which charges are specified on a usage basis, and in which there may be interruption of an individual call, attributable to a condition in Company’s shared interexchange facilities or in shared access or termination facilities provided by other carriers, which can be remedied by redialing the call and for all international calling by subscribers to these or other Company services:

 

                        .011      A credit allowance will be made for that portion of a call which is interrupted due to poor transmission (e.g. noisy circuit), one-way transmission (one party is unable to hear the other), or involuntary disconnection caused by deficiencies in Company’s service.  Where a call has been disconnected, the customer will receive a credit allowance equal to the charge for the initial minute of the call made to reestablish communications with the other party, the customer will receive a credit allowance up to an amount equivalent to the charge for the last three minutes of the interrupted call, or for the entire call if it lasted less than three minutes.

 

.012      A customer may also receive credit for reaching a wrong number.  A customer who has reached a wrong number will receive a credit allowance equal to the charge for the initial minute of the call to the wrong number if the customer reports the situation promptly to a Customer Service Representative.

 

.013      To receive a credit, the customer must notify its Customer Service Representative promptly and furnish information, including the called number, the service subscribed to, the difficulty experience, and the approximate time the call was placed.  If the customer elects to use another means of communications after one of the above interruptions, or during a period when the customer is unable to place a call over Company, the customer must pay the charges for the alternative service used.

 

.02       For all of Company’s services which involve dedicated access, dedicated interexchange transmission, and/or dedicated termination, for which monthly recurring charges applied, which are interrupted for more than an individual call and cannot be remedied by dialing the call except as provided in Section B-13.024 below, the customer will be given a credit allowance for an interruption of two (2) consecutive hours or more as follows:

 

.021      When service is interrupted for a period of less than two (2) hours, no credit allowance will be given.

 

                        .022      Dedicated interexchange line or linees and/or the access or termination line or lines associated with the service are interrupted for a period of two (2) to twenty-four (24) hours, a credit allowance in an amount equal to one thirtieth of the monthly recurring charge or charges will be given.

 

.023      When the service's dedicated access or termination line or lines associated with the service are interrupted for a period of more than twenty-four (24) hours, a credit allowance in an amount equal to one thirtieth of the monthly recurring charge or charges will be given for each twenty-four (24) hour period or fraction thereof.

 

                        .024      No credit allowance will be made for:

 

                                    .0241    Interruptions caused by the negligence of the customer or others authorized by the customer to use the customer's service.

 

                                    .0242    Interruptions due to the failure of power, equipment, systems, or services not provided by Company.

 

                                    .0243    Interruptions during any period which, Company or its agents are not afforded access to the premises where access lines associated with the customer's services are terminated.

 

                                    .0244    Interruptions during periods when the customer or authorized or joint user has released the service to Company for maintenance or rearrangement purposes, or for the implementation of a customer order.

 

                                    .0245    Interruptions during periods when the customer elects not to release the service for testing or repair and continues to use it on an impaired basis.

 

                                    .0246    Non-completion of calls due to network busy conditions.

 

                                    .0247    Interruptions during periods for tests and adjustments as may be necessary to maintain such services in satisfactory condition.

 

                                    .0248    Interruptions not reported to Company.

 

                 .025             An interruption period begins when the customer reports to Company that the service has been interrupted and releases the service for testing and repair.  An interruption period ends when the service is operative again.  If the customer reports the service to be inoperative, but declines to release it for testing and repair, the service is deemed to be impaired, but not interrupted.

                 .026             If the customer elects to use another means of communication during the period of interruption, the customer must pay the charges for the alternative service used.

 

                 .027             For the purpose of determining the amount of allowance, every month is considered to have thirty (30) days.  Only those segments of service actually affected by the interruption shall be considered in determining the amount of allowance.

 

       .03     As used in this Section B-13, the term "service" includes circuits or equipment provided by Company and/or a participating international carrier, or an overseas administration connecting with such international carrier.

 

       .04     At a customer's request and expense, Company will attempt to make arrangements for redundancy on the customer's service.

 

14.   APPLICABLE SERVICE REGULATIONS

 

       The regulations of this Section B shall apply to each of the Government Telecommunications Services furnished under this tariff except that, in the event that any of the provisions of Section C are inconsistent with any of the provisions in Sections A and B of this tariff, the provisions of Section C shall supersede those that are inconsistent to the extent required to resolve the conflict.

17.   RESERVATION AND ADMINISTRATION, OWNERSHIP, USE AND ASSIGNMENT OF TELEPHONE NUMBERS FOR MCI GNT 800 SERVICE

 

       .01     Reservation and Administration of 800 Numbers:  In its capacity as Resp Org, Company will act to reserve and administer 800 numbers in accordance with the effective procedures of the 800 Service Management System (SMS/800).

 

       .02     Use of Numbers: Each 800 telephone number must be placed into actual and substantial use by the customer.

 

       .03     If a customer of Gnt 800 is found to be non-compliant in passing back appropriate answer supervision, Company reserves the right to suspend service temporarily and/or deny requests for additional service.  Company shall give the customer 10 days written notice via certified U.S. Mail of intent to suspend or deny service due to such non-compliance.

19.   APPLICABILITY OF FEDERAL ACQUISITION REGULATIONS

 

       In addition to the regulations set forth above, Federal Acquisition Regulations, 48 C.F.R., Chapter 1, and agency supplements thereto, 48 C.F.R., Chapters 2-15, subject to all applicable exemptions, may apply to the provision of Government Telecommunications Service mandated by law or as otherwise agreed between Company and a customer.

SECTION C - SERVICE DESCRIPTIONS AND RATES

 

1.         GENERAL DESCRIPTION OF GOVERNMENT TELECOMMUNICATIONS SERVICE

 

            .01       Government Telecommunications Services are offered to subscribers on a full-time monthly basis, or on a Metered Use Basis.

 

            .02       All services shall remain in effect for a minimum of thirty (30) days, subject to the terms of any applicable Term Plan.

 

            .03       A customer may provide the dedicated LEC access facilities to access Company’s terminal for the provision of Government Telecommunications Service.

 

            .04       Company offers it services subject to the availability of the necessary facilities and/or equipment.  Company reserves the right to refuse to provide service to or from any location where the necessary facilities and/or equipment are not available (see Section B.2).

2.                GOVERNMENT DEDICATED TRANSMISSION SERVICE (GDTS)

 

            .01       General Description

 

Company Government Dedicated Transmission Services (GDTS) offers discrete intercity communications facilities which are dedicated to the use of a specific customer and are billed at pre-determined fixed monthly rates.  Except as otherwise provided, the customer may elect to have Company provide local facilities, may provide his own, or may arrange for any combination thereof.  GDTS may be provided for analog transmission and digital transmission and is offered in the modes described in Section C-2.011 through C-2.0112.  GDTS1 may be connected to Canadian and Mexican private line service.  Rates for the U.S. portion of such a connection are based on the rates in Section C-2.021 through C-2.022, herein.  The carriers in Canada and Mexico will charge their rates for the portion of the circuit in their respective countries.  Rates for services to Canada will be based on airline mileage to a border crossing determined by the Canadian carrier.  Rates for services to Mexico will be based on the airline mileage to the border crossing nearest the Mexican termination point, subject to capacity availability in Mexico.

 

1           Service to Canada is limited to Analog Service, Terrestrial Digital Service - 1.5, Digital Data Service (56 kbps option only), and Digital Private Line Service (excluding 64 kbps and Fractional T-1 speeds options).  Service to Mexico is limited to Analog Service.  Terrestrial Digital Data Service - 1.5, Digital Data Service (56 and 64 kbps options only), and Digital private Line Service (56 and 64 kbps and Fractional T-1 speeds options only).

                                                .01121  T-1 Digital Access - is high capacity digital access which relies on local exchange carrier T-1 technology to transmit at a speed of 1.544 mbps to connect customers' premises to Company terminals for use with Company services.  Company will make this form of local access available for GDTS Analog and Digital Inter-office Services as well as for MCI Gnt service (Section C-3.02) and MCI Gnt 800 service (Section C-3.03).

 

                                                .01122  Digital Data Access - is digital access which relies on local exchange carrier technology to transmit at speeds of 2.4, 4.8, 9.6, and 56 kbps to connect customers' premises to Company terminals for use with Company services.  Company will make this form of local access available for GDTS Digital Data and Digital Private Line Inter-office Services.

 

                                                .01123  DS-3 Digital Access - is high capacity digital local access which relies on DS-3 transmission technology at a speed of 44.736 Mbps.  Company will make this form of local access available for Government T-3 Service.

 

                        .012      Dedicated Inter-Office Services

 

                                    .0121    Analog Inter-Office Service:

 

                                                .01211  Voice Grade Service is offered in increments of one or more voice grade channels, each with nominal bandwidth of 4 kHz.  A customer may use such voice grade channels or combinations of voice grade channels, on a permissive basis, for voice service, data service, facsimile service or combinations thereof, and may interconnected with the facilities of other communications carriers and users for a customer's communications needs, such as voice connecting arrangements.  Company will provide, if required, a handset at each circuited as part of this service.  This service is available as point‑to‑point and multipoint,where capabilities permit.

 

                                                .01212  Analog Data Service is offered at approximate data speeds of 0‑300, 1200, 2400, 4800, 7200 or 9600 bits per second (bps).

 

                                    .0122    Digital Inter-Office Service:

 

                                                .01221  Government Digital Data Service (GDDS) is a point‑to‑point dedicated circuit used for simultaneous two‑way transmission at synchronous speeds of 2.4, 4.8, 9.6, 56, and 64 kbps.

 

                                                .01222  Government T-1 Service  is a point‑to‑point dedicated circuit used for simultaneous two‑way transmission of serial bipolar, isochronous digital signals at a transmission speed of 1.544 Mbps.

 

                                                .01223  Government Digital Private Line Service is a dedicated digital circuit used for voice and data communications at transmission speeds of up to 64 kbps and fractional T-1 speeds of up to 1472 kbps in 56 kbps or 64 kbps increments.  This service can be accessed by either Analog Local or Digital Local Access, including DS0 Access, Digital Data Local Access, T‑1 Digital Access or Terrestrial Digital Service - 45 Local Access.  Multipoint Service is available for analog data applications and for digital data communications at speeds up to 56 kbps.

 

                                                .01224  Government T-3 Service is a point-to-point dedicated circuit between customers premises that is used for simultaneous two-way transmission of serial bipolar, isochronous digital signals at a transmission speed of 44.736 Mbps.  One Government T-3 channel provides the equivalent information handling capacity of 28 Government T-1 channels or 672 voice grade equivalent circuits.  Government T-3 Service may be used for any combination of voice and data communications.

 

                        .013      Notification Required from Customers:  A customer must provide Company with a minimum of one month's written notice to disconnect a circuit.  All charges for dedicated transmission line services and service components ordered under this tariff and provided by Company, or by Company as agent when acting in the customer's behalf, will apply for one month from the time notice is received, or until the requested disconnection date, whichever is later.  The charges will apply whether or not the customer uses the circuit.

                                                            T-1 Digital Access is a high capacity digital local access arrangement which relies on T-1 transmission technology provided by the local exchange carrier and which will be used to conect customer's premises to Company terminals to provide customer access to Company services.

 

                                                            This form of access is available with the following service offerings: Digital Private LIne Service (Section C-2.027, Terrestrial Digital Service (TDS 1.5 and TDS-45), Digital Data and Analog Dedicated Leased Line Interoffice Services (Section C-2.0213).  MCI GNT 800 Service (C-3.03), GNT (C-3.02) and Virtual Private Data Services (C-3.04)

 

                                                            .021211            Local Access Channels:              Installation charges for each Local Access Channel will apply on an individual case basis, in accordance with the charges set forth in the relevant Local Exchange Carrier's interstate tariff as of April 15, 1992.  The monthly recurring and installation charges are found in MCI WORLDCOM Communication, Inc Tariff FCC No. 8.

                                                            .0212171          Bullet Proof Guarantee:  Customers subscribing to this feature are guaranteed service restoral, within one minute, in the event of Company-provided T-1 Digital Access circuit failure.  If this timeframe cannot be met, Company will provide a credit to the customer equal to one month's local access channel charges, after any discounts and taxes, for the affected circuit.  The credit will not include Central Office Connection (COC), Access Coordination (AC), ISDN PRI, and associated equipment charges. The monthly credit shall not exceed the discounted monthly recurring charges for the local access circuit.  No credits will be provided for non-recurring charges.  The credits will only apply when the customer has reported the outage or interruption to Company, and Company, in its sole discretion, has verified that the customer is eligible for the Guarantee.  This feature is available only at Company-designated locations, and only for T-1 circuits enrolled prior to the 10th day in the month prior to the outage.

 

This guarantee does not apply to the following: interruptions or outages caused by the customer; in cases where customer premises equipment is provided by the customer or any third party; during the period of time that the customer has released the circuit to Company for maintenance purposes, rearrangements or other order changes; and, when the customer elects not to release the circuit for testing or repair and continues to use it on an impaired basis.  This guarantee does not apply during busy conditions or Company Network failures.

 

                                                            .021218            Integrated Services Digital Network (ISDN) Service1: ISDN integrates voice, data, and video communications services via standard interfaces.

 

                                                                        .0212181          Primary Rate Interface (PRI): Through PRI, a customer can share access facilities among MCI GNT 800 Service and MCI GNT.  An attribute of PRI, Call-by-Call Service Configuration, allows for these services to share dynamically allocated individual circuits within the PRI.  Private Line Service is also available with the above combinations.

 

The PRI consists of a 64 kbps D channel and 23 B channels of 64 kbps each.  The bearer, or B, channels are used to access Company services supported over the PRI.  The D channels are used to carry signalling and control information for the associated B channels.

 

In addition to providing basic access to the Company services specified above, the PRI interface can be configured to support the following advanced ISDN features: Call‑by‑Call Service Configuration, Non‑Facility Assoicated Signaling, D‑Channel Backup, Automatic Number Identification (ANI), Dialed Number identification Service (DNIS) and, for GNT customers, Calling Station Identification (CSI).  Call‑by‑Call Service Configuration allows the B channels of a PRI to be shared between multiple services carried on the PRI.  With Non‑Facility Associated Signaling, one PRI D channel can control up to a maximum of 20 T‑1 Digital Access channels.  D Channel Backup provides a redundant hot stand‑by of the PRIs primary D Channel.  Automatic Number Identification (ANI) allows a customer to receive the originating caller's working telephone number provided this information is forwarded to Company by the caller's Local Exchange Carrier (LEC).  DNIS provides the called party with the number dialed by the customer or a translated version of the dialed number.

 

                                                            The delivery of ANI and DNIS is ordered along with MCI GNT 800 Service.  CSI is provided to GNT customers who order PRI.  T-1 Digital Access is required to obtain ISDN PRI.  Digital Private Line Service can be configured within an ISDN T-1 Digital Access Line.  Each time a change in the number of Private Line DS0s is required, a PRI reconfiguration charge will be assessed.  (See Section C-7.2.)

 

                                                            After initial installation of the PRI trunk group, a customer  may choose to add or delete groups of B channels in DS1 blocks.  Each time the trunk group size is changed, a trunk group rearrangement charge will be assessed.

                              .0212112    DRS Dynamic Allocation of Bandwidth

 

                                         DRS Dynamic Allocation of Bandwidth (DAB) ‑ Allows customers to reserve usage‑sensitive, virtual Company private line bandwidth, either on demand, or via scheduled reservation, in increments of 1.544 mbps (e.g. for use as disaster recovery backup of customer data processing facilities, video conferencing, and other digital network management functions). Reservations are made from a remote customer's premise(s).  Usage time must be reserved in 15 minute increments based on standard quarter hour definitions (e.g. 00:00, 00:15, 00:30, 00:45) and will be billed as such, rounded up to the nearest 15 minutes.  Reservations not cancelled or modified at least 15 minutes prior to the scheduled start time will be assessed charges for a minimum of 15 minutes of usage based on the mileage for that particular reservation.  DRS DAB can also be used in conjunction with DRS FNR.

            .0212113          ISDN ESP:  Allows Gnt 800 service customer to receive the telephone number (referred to as an ANI) from which the calling party has dialed at the time the call is answered.  ISDN ESP is available only with PRI access.  ANI will be available to ISDN ESP customers on calls originating from local exchange carriers' end offices with equal access Feature Group D signalling.

                      .02126  Access Pricing Plans:  Customers who order Dedicated Access Line Service from Company may subscribe to service through an Access Pricing Plan (APP) which qualifies the customer to receive discounts which apply against the applicable monthly local circuit rates.  Other charges (e.g., Access Coordination, Central Office Connection, and installation charges) described herein are not discountable under these plans.  For purposes of these APP's, Dedicated Access Line Service only includes channelized T-1 access, unchannelized T-1 access, DSO, DDS and Analog access.

 

An APP applies only to one access circuit.  The plan and its discounts are not transferrable to any other circuit, nor may the APP be transferred from one customer to another.

 

                                                .021261            Commencing an APP

 

All customer requests to commence an APP must be made in writing and received by Company no later than the 15th day of the month preceding the month in which the APP is to commence.  A customer must provide Company with one month written notice to change an APP. All charges for access facilities will apply until the requested disconnection date.  The charges will apply whether or not the customer uses the circuit.  The APP commences the day of installation for a new circuit, or the first day the Initial Circuit can be billed under the plan.

 

                                                .021262            Rate Changes

 

Customers whose circuits are subscribed through an APP are subject to all rate and discount revisions which are made during the course of the APP's term.  Customers who are enrolled in an APP on or before June 1, 1993, will be charged a rate no greater than the rate in effect on June 1, 1993 for the term of the plan.  A customer who enrolls either channelized or unchannelized T-1 Digital Access Circuits in an APP after June 1, 1993 will be charged a rate no greater than the rate in effect on the date the APP becomes effective, for the term of the plan.

 

                                                .021263            Early  Termination

 

Discontinuance of service under this tariff with or without termination liability is as specified in FAR Clause Nos. 52.249-02, 52.249-08 and/or GSAR Clause No. 552.209-72.

 

Customers who terminate service prior to the end of the committed term will be charged an early termination charge equal to the lesser of the following:

 

                                                                                  the number of months remaining in the term multiplied by 50 percent of the undiscounted monthly rate at the time of termination; or,

 

                                                                                  one month's undiscounted monthly rate at the time of termination for customers in a one-year APP; two months' undiscounted monthly rate at the time of termination for customers in a two-year APP; six months' undiscounted monthly rate at the time of termination for customers in a three-year APP; eight months' undiscounted monthly rate at the time of termination for customers in a four-year APP; and ten months' undiscounted monthly rate at the time of termination for customers in a five-year APP.

 

                                                Early termination charges will be waived under the following circumstances:

 

                                                                                              The customer upgrades its service from DDS or DSO or Analog to T-1 Digital Access, or from T-1 Digital Access to TDS-45 Local Access; the new services is provided from the Company facility to the same customer location as the disconnected service; and the written request to disconnect the circuit under the APP and to install the upgrade circuit are received by Company concurrently, with no lapse in service;

 

                                                                                              The customer replaces an APP for a given circuit with an APP expiring on or after the original APP for the same circuit;

 

                                                                                              The customer requests that a circuit be moved and:

 

                                                                                                -           The move is to another location in the same LATA; and

 

                                                                                                -           The new circuit at the new location is to be installed on or before the date the original circuit is disconnected; and

 

                                                                                                -           The new circuit is enrolled in an APP expiring on or after the APP on the original circuit.

 

                                                The customer is responsible for all applicable installation charges for the new circuit.

 

                                    .021264            Upon expiration of an APP, a circuit will be automatically resubscribed through an APP with the same term commitment as the original plan unless the customer states, in writing to Company, that it wishes not to be re-enrolled or to be enrolled in an APP of a different term than the original.  Such written notice must be received by Company no later than 30 days prior to the existing plan's expiration.

SECTION C - SERVICE DESCRIPTIONS AND RATES

 

3.         METERED USE SERVICE

 

            .01       GENERAL DESCRIPTION

 

                        Metered Use Service offers the use of intercity communications facilities shared among multiple users.  Company provides Government Telecommunications Services customers the following separate Metered Use Service Options: Option A (Gnt), Option B (Gnt 800), Option C (Virtual Private Data Service), Option D (MCI Forum Conference Calling), Option E (MCI Prepaid Calling Card Service), Option F (Government Emergency Telecommunications Service), Option G (GCI), Option H (MCI HyperStream Frame Relay) and Option I (MCI WorldCom On-Net Services).  Depending on the option(s) chosen, the customer may select the manner in which calls are originated and terminated, may obtain one-way or two-way service, may enjoy point-to-point or multipoint service, or may originate calls in multiple cities.

 

                        Government Telecommunications Service Metered Use Service Options involve, depending on the Option selected, a monthly subscription fee, a recurring monthly minimum charge for intercity facility usage, or a one-time initiation of service charge.  At additional cost, certain Metered Use Service Options offer a customer the ability to:  (1) identify the users and allocate the cost of their long distance service through the use of accounting codes, and (2) receive call records on magnetic tape.

 

                        Under each of the above Metered Use Service Options, excluding Option C and Option H, the individual customer's total monthly charges for use of the intercity communication facilities are based upon the total time the customer (account) utilizes such facilities.  In that regard, individual intercity facilities usage charges, as well as other specific charges, discounts and/or features are applicable to each individual service option.  A specific description of each of the Metered Use Service Options and it recurring and non-recurring charges, features, applicable discounts and service availability is contained in Sections C-3.02 and C-3.10 following.

3.         METERED USE SERVICE

 

            .04       OPTION C (VIRTUAL PRIVATE DATA SERVICE)

 

                        Unless specifically modified herein, all terms, conditions, rates and charges applicable to Metered Use Service Option S (Virtual Private Data Service (VPDS)) found in MCI WORLCOM Communications, Inc. Tariff FCC No. 1 shall apply.

 

            .5         OPTION D (MCI FORUM CONFERENCE CALLING)

                        Option D is a one‑way, multipoint service provided through Company, allowing the furnishing of long distance telecommunication service between a single calling station and two or more called stations, when at least one of the called stations is located in a different LATA than the calling station.  MCI Forum Conference Calling requires a teleconferencing bridge port for each calling station.  The necessary bridge ports are provided by a designated Company Conference Center and are available as a Dial‑Out, 800 Meet Me, Local Meet Me and Unattended Meet Me Service.  All MCI Forum Conference Calling calls are rounded to the next highest minute.  Calculations of usage begins at the connect time of the first called party and ends when either the last participant in the conference call disconnects or the Company Conference Center operator terminates the call.  If the computed charge includes a fraction of a cent, the fraction is rounded to the nearest whole cent.

 

                        A conference call is initiated by making a reservation of a date and time for the call.  Reservations of Company’s Forum Conference Calling Service can be placed 24 hours a day, seven days a week.  Conference calls can be held on any day of the week at anytime.  Cancellation of scheduled conference calls within thirty (30) minutes of the scheduled conference call time are subject to the charges specified below.

 

                        Unless otherwise indicated herein, the term "networkMCI Conferencing" shall be used interchangeably with the term "MCI Forum Conference Calling" when used throughout this tariff.

 

                        Except as otherwise stated below, all other applicable terms, conditions, features and charges as specified in MCI WORLCOM Communications, Inc. Tariff FCC No. 1, Section C‑3.17 (Option P ‑ Forum Conference Calling) will apply.

 

                        .51       Methods of Conference Calling

                        .063      Other Charges:

 

                                    .0631    Payphone Use Charge:  An undiscountable charge of 2 units per call is applicable to each MCI PrePaid call originating from a domestic payphone. This charge, which is in addition to standard tariffed usage charges and any applicable surcharges associated with Company service, applies for the use of the instrument used to access Company service and is unrelated to the Company service accessed from the payphone.  The payphone use charge does not apply to calls placed to MCI PrePaid Customer Service.

 

                        .064      Other Conditions of Service:

 

                                              Calls to 700, 800, 900 and 950 numbers and international Directory Assistance will not be completed using the MCI PrePaid card.

 

                                              Calls may only be charged against a MCI PrePaid card that has a sufficient available balance.

 

                                              MCI PrePaid card balances will be reduced and depleted based upon customer usage.  Customers will be given notice one minute before available card balance is depleted, based on the terminating location of the call.  When the balance of available time is depleted, the call will be terminated.

 

                                              MCI PrePaid cards are non‑refundable and will expire on the date specified on the card or the carrier or package in which the card is included.

 

                                              Company will provide a credit equal to one minute of applicable service for MCI PrePaid card calls that are interrupted or are subject to inadequate transmission.  Credits will not be issued when an interruption or service deficiency is:  (a) not reported to Company; or, (b) due to failure of power, equipment or systems not provided by Company.

 

                                              This offering will be available to a single government entity from the effective date of this tariff through July 1, 1995.

 

            .07       Option F (Government Emergency Telecommunications Service (GETS)

 

                        Government Emergency Telecommunications Service (GETS) is a custom integrated switched telecommunications service which allows the customer enhanced survivability and priority treatment for its communications by integrating specialized capabilities into both the Company switched network and private Government networks and services.

 

                        .071      Rates and Charges:

                                                 .07132 Per-Call Surcharges:  The Customer will be charged a $0.75 per-call surcharge for operator-assisted calls.

 

                                    .0714    Other Charges: An undiscountable $0.30 per call charge is applicable to calls that originate from any domestic payphone used to access Company services as follows.  This charge, which is in addition to standard tariffed usage charges and any applicable surcharges associated with Company service, applies for the use of the instrument used to access Company service and is unrelated to the Company service accessed from the payphone.  Customers of GETS will be charged the payphone use charge for each domestic payphone call made using GETS.  The payphone use charge does not apply to calls placed from payphones at which the customer pays for service by inserting coins during the progress of the call.

 

                       .072      Other Requirements

 

                                    The Customer must commit to an initial term of service of 36 months.  To be eligible to continue to receive GETS following the expiration of this 36-month period and the end of each subsequent annual period of the term of service, the Customer must commit to a term of service of 12 months.

 

3.         METERED USE SERVICE

 

            .08       OPTION G (GCI)

 

                        Government Connections International (GCI) is a customized virtual network telecommunications service.  It provides a unified service for multi‑location organizations, providing both communications and management features.  GCI is suitable for long distance calls between company locations, as well as all long distance calls to the entire U.S. and to those international locations listed in Table V, Part E.  Call Detail Tapes and Location Level invoices are available under this program.  Customers under this option are not eligible to receive the benefits of promotional offerings or additional discounts as described in this tariff.

 

                        Subscribers to GCI take a Basic Feature Package which includes the availability of Dedicated and Switched Access and Termination; international calling to the international locations listed in Table V, Part E; Long Distance Directory Assistance; Accounting Codes and a consolidated invoice for all GCI calls from all locations.

Tariff FCC No. 1.  Subscribers can dial overseas toll free numbers on a country specific basis to reach an Company operator located in the U.S.  The Company operator will process the subscriber's call based on its authorization number validation and calling range privilege.

SECTION D - RATES FOR SUPPORTIVE SERVICES

 

1.         General Description of Supportive Services

 

            .01       Supportive services are those for which Company has established rates to cover various areas of support to satisfy certain customer requirements which are considered supplemental to those areas normally provided by Company as part of its service.

 

2.         Supportive Services

 

            .01       Supportive Services are provided to subscribers to Company’s services who are acting on behalf of themselves, joint users, or authorized users.  Company, at its option, and subject to the provisions of Section B-6 preceding, will support the customer's interaction and administrative involvement with the joint and authorized users as outlined in Sections D-2.02 through D-2.04 following.

 

            .02       Company will, at its option, develop recurring and non-recurring charges for the provision of specialized billing arrangements and/or detail sorted by individual sub-user provided to customers of its Dedicated Leased Line Service offering who are acting on behalf of joint and authorized users.  The amount of these charges will depend upon both the level of support requested by the customer and the ability of Company to comply with the customer's request.  These provisions do not affect the customer's ultimate responsibility for payment of all charges for joint or authorized user services.

 

            .03       At the customer's option, additional Supportive Services are available for all Company services at the daily rate set forth below.  These supportive Services include, but are not limited to, such areas as training of customer personnel, administration of joint or authorized user groups, compilation and generation of information necessary for submitting and processing and Application for Service, etc.

 

                        -           $520.00 per day - customer is also responsible for all travel and per diem expenses.

 

            .04       Engineering or sales support by Company to assist the customer in interactions with joint or authorized users may be requested by the customer.  In this case, the rates in Section D-4 apply.

 

3.         Special Construction

 

            .01       Basis for Rates and Charges

 

            Rates and charges for special construction will be based on the costs incurred by Company and may include (a) non-recurring type charges, (b) recurring type charges, (c) termination liabilities, (d) underutilization liabilities, or (e) combinations thereof.

 

            .02       Basis for Cost Computation

 

            The costs referred to in Section D-3.01 preceding may include one or more of the following items to the extent that they are applicable:

 

                        .021      Cost installed of the facilities to be provided, including estimated cost for rearrangements of existing facilities.  Cost installed includes the cost of:

 

                                    (a)        equipment and materials provided or used,

                                    (b)        engineering, labor and supervision (including necessary overtime),

                                    (c)        transportation,

                                    (d)        rights-of-way, and

                                    (e)        express shipping of equipment and other expedite charges deemed necessary by Company to provide the requested service.

 

                        .022      Cost of maintenance,

 

                        .023      Depreciation on the estimated cost installed of any facilities provided, based on the anticipated useful service life of the facilities with an appropriate allowance for the estimated net salvage,

 

                        .024      Administration, taxes and uncollectible revenue on the basis of reasonable average costs for these items,

 

                        .025      License preparation, processing and related fees,

 

                        .026      Tariff preparation, processing and related fees,

 

                        .027      Any other identifiable costs related to the facilities provided,

                        .028      An amount for return and contingencies.

 

            .03       Termination Liability

 

            To the extent that there is no other requirement for use by Company, a termination liability may apply for facilities specially constructed at the request of the customer to meet its require­ments.

 

                        .031      The termination liability period is the estimated service life of the facilities provided.

 

                        .032      The amounts of the maximum termination liability is equal to the estimated amounts for:

 

                                    (a)        Cost installed of the facilities provided including estimated costs for rearrangements of existing facilities and/or construction of new facilities as appropriate, less net salvage.  Cost installed includes the cost of:

 

                                                (i)         equipment and materials provided or used,

                                                (ii)        engineering, labor, and supervision,

                                                (iii)       transportation, and

                                                (iv)       rights-of-way.

 

                                    (b)        License preparation, processing, and related fees,

 

                                    (c)        Tariff preparation, processing, and related fees,

 

                                    (d)        Any other identifiable costs related to the specially constructed or rearranged facilities.

 

                        .033      The applicable termination liability charge is based on the normal method for calculating the unpaid balance of a term obligation.  The amount of such charge is obtained by multiplying the sum of the amounts determined as set forth in D-3.032 preceding by a factor related to the unexpired period of liability and the discount rates for return and contingencies.  The amount determined in D-3.032(a) preceding shall be adjusted to reflect the predeter­mined estimated net salvage, including any reuse of the facilities provided.  This product is adjusted to reflect applicable taxes.

 

            .04       Underutilization Liability

 

            To the extent that there is no other requirement for use by Company, a charge may apply after an initially agreed upon period, and annually thereafter for voice grade type facilities or a portion thereof specially constructed to meet the forecasted needs of the customer between the customer's terminal location and Company locations, where the customer utilizes such facilities in an amount less than 70 percent of its forecasted requirements.

 

            .05       Ownership of Facilities

 

            Title and/or right to possession to all facilities provided in accordance with this tariff remains in Company and/or its affiliates.

 

4.         Additional Engineering and Labor and Trouble Reporting

 

            .01       Additional Engineering

 

            Additional engineering is that engineering or engineering consultation requested by the customer as described in Sections D-4.011 through D-4.013 following.  Company will notify the customer that additional engineering charges as specified in Section D-4.04 following will apply before any additional engineering is undertaken.

 

                        .011      Design Change or Cancellation

 

                        A design change or cancellation is a change or cancellation requested by the customer.

 

                        .012      Engineering Consultation

                        Engineering consultation is the obtaining of technical advice from Company by the customer not in connection with a specific order, and situations in which the customer requests Company to provide information or to perform a function which will entail additional engineering by Company.  This does not include brief inquiries where no significant engineering time is required or inquiries associated with customer facility forecasts.

 

                        .013      Expedited Engineering

 

                        Expedited engineering is the engineering effort required to meet customer requests for less than normal engineering design interval.

 

            .02       Additional Labor

 

            Additional labor is that labor requested by the customer on a given facility as described in Section D-4.021 through D-4.025 following.  Company will notify the customer that additional labor charges as specified in Section D-4.04 following will apply before any additional labor is undertaken.

 

                        .021      Overtime Installation

 

                        Overtime installation is that Company installation effort outside of regularly scheduled working hours.

 

                        .022      Additional Installation Testing

 

                        Additional installation testing is that testing performed by Company at the time of installation which is in addition to normal pre-service acceptance testing.

 

                        .023      Overtime Repair

 

                        Overtime repair is that Company maintenance effort performed outside of regularly scheduled working hours.

 

                        .024      Stand By

 

                        Stand By includes all time in excess of one-half (1/2) hour during which Company personnel stand by to make coordinated tests on a given facility.

 

                        .025      Other Labor

 

                        Any additional labor not included in Sections D-4.021 through D-4.024 preceding which may be undertaken at the customer's request.

 

            .03       Trouble Reporting

 

            In systems furnished by multiple common carriers where a customer patron is unable to identify the appropriate carrier for trouble reporting purposes, Company will, at the request of the customer, accept trouble reports from the customer patron.

 

            .04       Additional Engineering

 

                        The rates for additional engineering are as follows:

SECTION E ‑ INTERNATIONAL SWITCHED VOICE SERVICE

 

1.         General Description

 

            International Switched Voice Service (ISVS) is available to the Department of Defense, Defense Information Technology Contracting Office (DITCO), for outbound calls originating from the U.S. Mainland, and for inbound calls originating from the locations listed in Section E-3.021, subject to the provisions set forth under this Tariff, unless otherwise stated herein.  These per-minute rates shall apply in lieu of the rates and charges set forth for Metered Use Service Option G (Vnet) found in Section C-3.0739 of MCI WORLCOM Communications, Inc. Tariff FCC No. 1.

 

2.         Rates and Charges

 

            International calls which begin in one rate period and end in another will be charged the rate in effect at the time the connection is established.  Rates are country specific (do not change within a given country) and are in effect seven (7) days a week, twenty-four (24) hours a day. If the computed charge includes a fraction of a cent, the fraction is rounded to the nearest whole cent.

 

            International calls made by customers to the countries in Section E-2.02 of this tariff will be calculated on a thirty (30) second minimum duration basis, with additional charges for each six (6) second increment.

 

            All outbound (U.S. to international) calls are priced based upon the local time the call is placed at the call's point of origination.  All inbound (international to U.S.) calls are priced based upon the local time the call is placed at the call's point of termination.
